Have you dealt with this at all?

Banned members who threaten to sue you for banning them from your forum or not removing their account/content?

How did you respond or how would you respond to such a threat?

Good luck lol
Or ignore them AKA “don’t feed the trolls”
Or pretend to take them seriously by trolling them back

Been there done that. Long story short the case never went to court.
You sued or a member threatened to sue you? I wonder whether it’s related to Bash Zone. lol

Only of you’re open to sharing though

On another note would you ban a member not already banned who threatens to sue you?

Probably. I mean, if they're being threatening, to me, that says they don't want to be on the forum. Right? Or they want me to submit to their demands.

Don't threaten me. Just do it, or shut up. That's kind of my philosophy on people who make threats. You don't have to threaten to sue me to make me conform, just do it, and I'll get subpoenaed by your lawyer, and what happens after that happens?

I think people who make those threats are control freaks.

At least on a forum.

Of course, in some cases, maybe not. Such as the case of a forum owner abusing the member or defrauding them of a right (such as privacy) of some kind.

Would you ban a member who sues you without threatening you directky?

I guess it depends on the lawsuit. If I could ban them without repercussion against me, then I would consider it.

I see it this way - if you sue me and win, we're not any friends anymore. I'll put you on ignore on any forum I join with you on it. I feel like it would be justified to block you from my own forum.

Am I wrong?

I doubt it matters if the person wins or loses; given the stress, time and legal expenses you had to go through the damage is done, with the exception being an out of court settlement provided it’s amicably settled and not a vexatious lawsuit.

Besides the possible exceptions of discrimination and retaliation for complaints/lawsuits on that, I’m not sure on that really, you’re legally entitled to ban for any reason. But it’s likely to spike drama and reflect badly on you if you were in the wrong imo.

I assume the scenario we’re discussing is not one that’s clear-cut where you are in the wrong both legally and ethically. But still, what about the potential rage quits and fallout that results? Would you then proceed to ban all the members who are friends with the members who sue you? Where do you draw the line? I also read somewhere you experienced a fallout when you banned a person known as a troublemaker and lots rage quit

I think I would handle it this way:

1. I'd ban the member unless otherwise stated in the suit
2. I'd offer self-delete to those who disagree to the point to where they're dramatic about it

I think that would be the best possible approach rather than submit to someone who is now your sworn enemy :P

I can't say that I have ever had a member that was banned threaten to sue me, they had a few choice words when they found out about the ban but nothing overly serious.

I would imagine some have gone through it though, you do tend to get some people who take it a little too far with the threats.

Was just pointing out that win or lose, the damage is still done :P Of course you wouldn’t be friends on any level but how would you feel about letting a member who’s basically dead to you stay on your forum and just completely ignore them? :D
